This Rental Agreement ("Agreement") is entered into by and between Two Buds, LLC and the client submitting this agreement. By submitting or signing this agreement, the client acknowledges and agrees to all policies, terms, and conditions outlined below.
1. Rental Services
Two Buds provides the rental of artificial floral arrangements for weddings and events. The specific items, rental dates, and client information will be confirmed during booking. All rentals include a 3-day rental period. Additional days may be added for $50 per day. Additional days must be confirmed at the time of booking.
2. Payment Terms
All rentals require a 50% non-refundable payment of the total rental cost at the time of booking. The remaining 50% balance is due 90 days prior to the Client’s wedding date. For bookings made within 90 days of the wedding date, payment in full is required at the time of booking. Each invoice must be paid by the due date listed on the invoice. Card payments only are accepted.
3. Rental Protection & Maintenance Fee
A non-refundable Rental Protection & Maintenance Fee equal to seven percent (7%) of the rental subtotal will be added to all rental orders. This fee covers normal wear and tear, routine cleaning, and minor repairs. The Rental Protection & Maintenance Fee is not a security deposit and is not refundable under any circumstances.
The Rental Protection & Maintenance Fee does not cover excessive damage, theft, loss, failure to return rental items, or damage resulting from negligence, intentional acts, improper handling, exposure to outdoor conditions, or use contrary to the instructions provided by Two Buds. The Client remains fully responsible for the cost of repairing or replacing any rental items that are lost, stolen, destroyed, or damaged beyond normal wear and tear. Two Buds reserves right to determine what constitutes excessive damage.
Two Buds reserves the right to invoice the Client for any repair or replacement costs exceeding the coverage provided by the Rental Protection & Maintenance Fee. Payment for such charges shall be due within ten (10) days of receipt of the invoice.
4. Delivery, Pickup, and Installation
Client pickup and drop-off is free of charge. Pickup and drop-off location is in Newton, KS. Wedding day delivery and installation by Two Buds is available for an additional fee. This fee is dependent on individual order size. This fee will be stated on the initial quote. Starting rate is $100. If the venue is over 30 minutes away from Newton, KS, an additional $2 per mile will apply. All logistics (pickup/delivery/installation) must be finalized at the time of booking.
5. Cancellations, Refunds, and Fees
If the Client cancels their rental agreement 90 or more days before the event date, the initial 50% payment made at the time of booking will be retained by Two Buds, and any additional payments made toward the rental will be refunded. No refunds will be issued for cancellations made within 90 days of the event date. Once the event has taken place, all payments are final and non-refundable.
6. Client Responsibilities
Client agrees to care for all rentals and avoid damage during the rental period. Client agrees to return or make available all items on the agreed-upon date. If rental is returned late, the Client agrees to a $200 late-fee charge per day. Communication and confirmation of rental details must occur before the booking is finalized.
7. Client Pickup, Transport, and Self-Setup Liability
For clients who elect a rental period that includes client pickup and return of items, all responsibility for the care, handling, transportation, and setup of rented items transfers to the client at the time of pickup. Two Buds shall not be liable for any damage, loss, or destruction of items occurring during transportation, handling, or self-installation performed by the client or any third party acting on the client’s behalf.
The client assumes full responsibility for ensuring that all items are transported safely and installed appropriately. Any damage incurred during this period—including but not limited to breakage, structural damage, weather exposure, or improper setup—will be the sole responsibility of the client.
Damage resulting from client transportation or self-setup does not constitute grounds for a refund of any kind.
By opting for client pickup and self-setup, the client acknowledges and agrees to these terms and releases Two Buds from any and all related claims, liabilities, or damages arising from the use, transport, or installation of rented items during the rental period.
8. Force Majeure
Two Buds shall not be liable for any failure or delay in performance of services due to circumstances beyond its reasonable control, including but not limited to illness, injury, emergencies, weather conditions, acts of God, equipment failure, or other unforeseen events (“Force Majeure Events”). In such instances, Two Buds reserves the right to cancel or reschedule services at its sole discretion. Client agrees that Two Buds shall not be held liable for any resulting damages, losses, or expenses. Refunds or credits for undelivered services may be issued at the sole discretion of Two Buds.
9. Additional Terms
By booking with Two Buds, the Client agrees to all terms outlined in this Agreement. Two Buds may use photos of the floral arrangements at the Client's event for promotional purposes unless otherwise requested in writing. This Agreement is governed by the laws of the State of Kansas.
